Access to documents
What is the right of access to administrative documents and who can exercise it?
It is the right to inspect and obtain copies of administrative documents.
All private individuals, including those with public or widespread interests, who have a direct, concrete, and current interest in a legally protected situation connected to the document being accessed, may exercise this right.
The application may be submitted directly by the individual or by a designated representative: legal representative, attorney, or guardian. The proxy, along with a photocopy of the person's identity document, must be attached to the request.
What more could you ask for?
It is possible to request any administrative document intended as a graphic, photographic, cinematographic, electromagnetic or any other type of representation of the content of documents.
For example, a parent can request: a copy of a teacher's personal records regarding their child, a copy of the criteria adopted by the Institute in adopting a specific act, etc.
What can't you ask for?
The following documents cannot be accessed:
1. Documents covered by a disclosure prohibition under law or government regulations.
2. Documents relating to teaching and non-teaching staff or students in whom there is no legitimate legal interest.
3. Documentation relating to the School's activities aimed at issuing general regulatory, planning and programming acts
4. Documents relating to staff or student selection procedures containing psychological or attitudinal information relating to third parties.
5. Documents concerning sensitive data of natural persons, when they concern inviolable rights guaranteed by the Constitution, such as, for example: race, religion, political opinions, health, religious beliefs, criminal records, correspondence, family status, economic and maintenance relationships. Access to these documents is guaranteed when strictly necessary for the protection and defense of legal interests.
